Terms of Service
1. Scope
These terms govern (a) your use of this website and (b) the general framework for the digital products we publish and the software services we provide. Specific purchases made inside our apps will additionally be governed by the terms shown at checkout, and client projects by their own signed agreements, which prevail over this document where they differ.
2. Use of this website
You agree to use this website lawfully and respectfully. In particular, you must not:
- Attempt to breach or test the security of the site without authorisation
- Copy substantial parts of its content without permission
- Use it to send unlawful or unsolicited commercial communications
3. Intellectual property
The website and all its content belong to GumGum Labs or are licensed to it (see our Legal Notice). Our apps and their code, design and content remain our property; purchasing a licence to use an app does not transfer ownership of it.
4. Digital products and purchases
- Our apps Appothecary and Fastory will be distributed through app stores at launch. Downloads there are also subject to the store's own terms.
- Optional in-app content and features may be purchased as one-off payments or subscriptions. Where Stripe is used as payment processor, card data is handled exclusively by Stripe under its own terms and privacy policy.
- Before any purchase you will see the price (including taxes), what you get and how billing works for subscriptions. Refunds and cancellations follow our Refund & Cancellation Policy.
- Digital content is licensed to you for personal use. You may not resell, redistribute or extract content from our apps for other purposes.
5. Software services to businesses
Development and consulting engagements are governed by a written agreement per project covering scope, deliverables, timelines, fees, confidentiality and intellectual-property assignment. Nothing on this website constitutes a binding offer to provide services at a given price.
6. Availability and changes
We aim to keep the website available and accurate, but we may modify, suspend or discontinue parts of it, our products or these terms. Material changes affecting active purchases or subscriptions will be communicated in advance through reasonable means (for example, inside the app).
7. Warranties and liability
Our digital products are provided with the features described at purchase. To the extent permitted by law, we exclude liability for indirect damages and for events beyond our reasonable control. Nothing in these terms limits rights that mandatory consumer-protection law grants you — those always prevail.
8. Governing law and jurisdiction
These terms are governed by Spanish law. Disputes go to the courts of the city corresponding to GumGum Labs' registered address, unless mandatory consumer-law rules assign jurisdiction to the consumer's domicile.
